GENERAL TERMS AND CONDITIONS

The following describes the terms you agree to by viewing information on the www.brumbee.com.mx site.

By browsing, accessing or using this site, you acknowledge that you have read, understand and agree to be bound by the provisions of these terms and to comply with all applicable laws and regulations. If you do not agree to these terms, do not use this site. This site may without notice, modify these terms of use and any other information contained herein.

WHEN BROWSING OR ACCESSING INFORMATION

This site contains proprietary notices and copyright information, the terms of which must be observed and followed. See the link under the heading “trademarks” for related information.

BrumBee® grants you a limited, non-exclusive, non-transferable permission to access and view the pages on this site as a customer or potential customer, provided that you comply with the terms of use, and all copyright, trademark, and other proprietary notices. The use authorized under this agreement is non-commercial in nature (e.g., you may not sell the content you access on or through this site). Any other use of this site is prohibited.

The content of this website, text, images and their arrangement are part of the BrumBee® trademark. All trademarks, customer logos used or mentioned on this website belong to their respective owners.

RESPONSABILITIES

You are responsible for compliance with the laws of the jurisdiction from which you access this web site and you warrant that you will not access or use the information contained in this site in a manner that would violate such laws. Any information you submit to us through this site shall be deemed to be non-confidential and non-proprietary in nature.

BrumBee® does not accept the unauthorized submission of information when it is not covered by a prior expressly established business relationship. To protect our own interests and the interests of our existing customers, we must treat such submissions with the utmost care. It is important to note that in the absence of an express business relationship, BrumBee® does not treat any such submissions as confidential.

PAYMENTS BY CREDIT OR DEBIT CARD

These conditions of use (General Conditions) constitute a contract between any person (hereinafter User or plural Users) who wishes to contract the use of BrumBee® ERP Cloud licenses and access and/or use the credit or debit card payment service, property of EPSA Servicios Estratégicos SA de CV, hereinafter referred to as EPSA, in which case the User will be subject to the terms and conditions that govern the use of BrumBee® services.

These General Conditions describe the rights and responsibilities of the User and EPSA when using the payment services by credit or debit card.

The User must read, understand and accept all of the conditions set forth in these Terms and Conditions and other policies and principles incorporated herein by reference prior to using the service.

Any person who does not accept these general terms and conditions, which are of a mandatory and binding nature, should refrain from using the site and/or the payment services.

1-PAYMENTS BY CREDIT OR DEBIT CARD

A) Registration: Any user who wishes to use the service does not require an account registration, since the purpose of the payment by credit or debit card is to activate a license use environment, which has finished its period of use in its demo version or a new productive environment of BrumBee® for your company.

B) Pre-payment request information: Pre-payment request information is stored on our BrumBee® servers for the purpose of issuing you an invoice after your purchase.

C) Information of your credit or debit card: This information is not stored in our information records, however, it is used through the BBVA Bancomer Openpay platform, which we have contracted to provide the electronic payment service from the BrumBee® portal. This platform has anti-fraud technology that offers the highest levels of security provided by the bank for this type of transactions.

D) User Responsibilities: The User is responsible for the accuracy of the information provided and its handling, and may not allow or authorize the use of your information by third parties in our payment platform. The transactions will be understood to be carried out in the legal currency: Mexican pesos, except in those cases where another currency is expressly indicated.

E) Application Liability: EPSA shall not be liable for erroneous or incomplete orders, instructions and/or payments caused by the user’s erroneous entry of information or payment transaction.

F) License Activation: The customer service area will contact you to give you the corresponding support and training within a maximum period of 12 hrs. during business hours from 9:00 am to 5:00 pm. Consult our contact section in our web page www.brumbee.com.mx to contact us via telephone.

G) Capacity: Only those persons who have the legal capacity to contract may enter into payment transactions. Minors or persons who do not have the capacity to contract any service will not be able to register or use the services.

H) Limitation of liability for the service and/or platform: EPSA does not guarantee continuous or uninterrupted access and use of the card payment system. The system may eventually be unavailable due to technical difficulties or internet failures in the links or any other circumstance beyond BrumBee®’s control. Users may NOT hold EPSA liable for any damages resulting from the aforementioned difficulties, as well as for any other kind of damages, including indirect, special or consequential damages arising or experienced by users, even in the event that such failures affect the amounts to be paid or credited

2-PAYMENT MANAGEMENT

A) Monthly payment management: The user, when making use of this service, accepts the payment management contract on a monthly basis by the billing and collection area of EPSA, after the payment made with the card considering the months contracted in the operation. The corresponding invoice will be sent between the 1st and 5th of each month, having a cut-off date on the 25th of the same month that presents the date of issuance of the invoice, where the bank data for the payment appears.

B) Suspension of service: The parties agree that if the invoice is not paid on the agreed date, the service will be suspended on the last day of the month, reinstalling the service 24 hours after the pending payment.

C) Loss of discounts: Additionally, if the customer has any discount for the volume of licenses contracted and could not pay according to the cut-off date, the customer will lose the discount considered on the pending invoice, so it will be generated an additional invoice for the difference under the concept “Unauthorized Discount” indicating the month to which it corresponds.

3-DESPUTE RESOLUTION.

A) The users of the BrumBee® payment platform, in exercise of their rights under the Federal Consumer Protection Law, may initiate the corresponding actions through the CONCILIANET system of PROFECO and/or before the competent PROFECO delegations.

B) The users accept not to impute any responsibility to EPSA for suspending the performance of its mandate during the time that it takes to process the mediation, not being able to allege under any circumstance the negligence or distraction of the resources used to provide the service in the BrumBee® platform.

C) In the event that for any reason PROFECO is considered incompetent to settle the dispute, the user may exercise the corresponding actions before the competent authority.

D) In the solution of controversies through mediation, subject to the Protected Purchase, the refund of funds to a user will be made only when there are elements that can justify such decision, in a sufficient and reasonable manner, making such refund only to the bank account indicated by the user, adhering to the procedures and times provided in the applicable legislation.

E) The addresses established in the Payment Management Requests will be considered valid and valid for all pertinent legal purposes, unless the users establish another address in a reliable manner in their claims before PROFECO or any other competent authority.

I. User session

Most BrumBee® products use user sessions, which manipulate information temporarily stored in the memory of the different devices you use, to store your browsing preferences and make it easier for us to personalize information or advertising services.

II. Personal data collected

BrumBee® collects personal data through your company through the initial data upload process or through interaction when using our products.
The data collected from you or your company is:

  • A) Personal data. – RFC, CURP, social security number, date of birth, gender, address, cell phone, home phone, emergency contacts and insurance.
  • B) Employment data. – Company in which you work, work area, position, work schedule, date you joined the company and who authorizes leaves and vacations.
  • C) Personal documents. – Defined by your company as contractual documents such as your employment contract, official identification, medical record (IMSS), birth certificate, among others.

III. Our use of your personal information 

Your personal and work information allows you to have a simple experience when using BrumBee® because by being identified from your login, we can customize the sending of notifications via email when:

  • You make password change.
  • You request permissions or vacations from any device.
  • You have been accepted or denied vacation or work permits
  • You have been assigned to participate in customer projects.
  • You request an invoice.
  • You are assigned a consultant to attend a service ticket registered by you.
  • An important document has been shared with you by one of your collaborators.

Likewise, when you request help through BrumBee® customer service, our consultants receive your requests identifying your company, your name and work contact phone numbers as well as your email to contact us and give you personalized and timely attention.

IV. How do we share your personal data?

When we process your personal data, we do so with your or your company’s consent to provide for the licensed use of our products or to fulfill our contractual and security commitments to our customers based on legitimate interests in the operation of our BrumBee® products.

Product improvement. – We use the data to improve our products

our products on an ongoing basis, adding new features and functionality to provide you with a better experience.

Personalization. – Our products include personalization and behavioral role features that improve productivity and security in the management of company information.

Product activation. – We notify you via your email account when your BrumBee® user is activated.

Product development. – We use the data you register in customer service, identifying your needs to increase productivity and develop new products and incorporate them as part of our BrumBee® brand.

Protection and troubleshooting. – We identify information that helps us solve problems in our products, avoiding code injection, unauthorized access, performance and compatibility to increase security levels.

Upgrades. – We develop updates based on the information collected such as geographic location for attendance and punctuality controls, the identification of your device and its capacity, the version of the internet browser and the operating system among others.

Advertising. – BrumBee® does not use the content of your emails and chats to target advertisements to you, we only use information collected from interactions with you when using any of our products.

Business Intelligence. – We analyze the operations in the interaction with our clients with business intelligence in order to generate crucial in order to generate crucial information for decision making.

Copyright and intellectual property protection – We use the information to detect piracy issues, prevent fraud, resolve disputes, enforce contracts with our customers, protect our brand and BrumBee® products.

V. How can you have access to your personal data?

You have access to consult your personal file, where you will be able to see your personal data, contractual data, documents required by your company for hiring, insurance and emergency contacts. If there is any incorrect information, you must notify your company through the human resources area.

VI. Information provided by your organization

The initial information that is loaded in BrumBee® is provided by your organization with your personal and labor data. Subsequently, your organization receives training to manage the human resources processes, such as personnel additions and deletions, allowing them to capture the information and incorporate the digitalized documents that you provided to your company.

VIl. Security of your personal data

We take into account that any user could be connected to public or private access networks, which may or may not have security schemes, so our platform makes use of https security protocols that encrypt the information that is transmitted from any computer to our servers, avoiding that even if the network where you are vulnerable, your data cannot be decrypted during transmission because they are encrypted and only our server can make it visible.

Additionally we have perimeter security (firewall) to prevent unauthorized access to our servers.

VIll. Proccessing and storage of your personal data

Your personal information is processed and stored in a database from the initial upload requested by your company, or by the personnel registration process carried out by your human resources area.

This data can only be updated from BrumBee® by the person who has the privileges, which is usually the person responsible for human resources in your company.

If you stop working for the company that uses BrumBee®, the termination process that takes place changes your information to inactive status, and prevents it from being consulted by you or any collaborator of your company.

BrumBee® handles statistical information such as time spent on customer projects where you have been assigned to collaborate, so this information can be consulted as part of statistical reports or executive dashboards for decision making, even if you no longer work in that company.

IX. Free or trial versions

The implementation process of BrumBee® requires the creation of a trial work environment, which is activated at the time of signing the contract by your company, so if this does not happen, this environment will be deactivated and deleted.

X. Software and mobile devices

BrumBee® has a unique responsive version of its products. This means that it adapts to the configuration of your mobile devices, which allows us to make it easier to use for our customers, avoiding the need to use applications that are installed for cell phones and tablets.
